Terms of Service
Short version: Growtsy is an AI tool for Etsy sellers. You own what you upload. We don't guarantee sales or rankings. You can cancel anytime. Payments are processed by Paddle (our Merchant of Record). Questions: hello@growtsy.com.
By accessing or using Growtsy (growtsy.com), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the service. Please read these Terms carefully — they include limitations on liability and other important provisions.
1. The Service
Growtsy is an AI-powered optimization tool for Etsy sellers. It provides listing analysis, keyword research, trend insights, product photography generation, and related features (together, "the Service"). We are not affiliated with, endorsed by, or sponsored by Etsy, Inc. All trademarks (including "Etsy") belong to their respective owners.
Growtsy is operated by an independent developer based in Istanbul, Türkiye. All payments are processed by Paddle (our Merchant of Record), as described in Section 4.1.
2. Eligibility and Account
You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use Growtsy. By creating an account, you confirm you meet this requirement.
You are responsible for:
- Maintaining the confidentiality of your login credentials.
- All activity that occurs under your account.
- Providing accurate registration information and keeping it up to date.
- Notifying us immediately of any unauthorized access via hello@growtsy.com.
3. Acceptable Use
You agree to use Growtsy only for lawful purposes and in compliance with these Terms. You must not:
- Use the Service to create misleading, deceptive, or infringing listings.
- Violate Etsy's Terms of Use or Seller Policy when applying Growtsy outputs to your shop.
- Upload content you do not own or have permission to use.
- Reverse-engineer, scrape, or attempt to extract the Service's underlying code or AI prompts.
- Use the Service to generate content that is illegal, hateful, sexually explicit, defamatory, or infringes others' intellectual property.
- Abuse the referral system, credit system, refund policy, or any other mechanic to extract unearned value.
- Share, resell, or redistribute access to your account.
We may suspend or terminate accounts that violate this section without refund.
4. Subscriptions, Credits, and Payments
4.1 Merchant of Record
All payments for Growtsy are processed by Paddle, our Merchant of Record. The Paddle company that sells to you depends on where you buy: Paddle.com Inc. in the United States, Paddle.com (Canada) Ltd. in Canada and Paddle.com Market Limited everywhere else, as set out in Paddle's Buyer Terms; your receipt names it. Paddle handles payment processing, billing support, invoicing, and the collection and remittance of applicable taxes (including VAT and sales tax). Your transaction contract for the purchase is with Paddle; your service contract for Growtsy is with us.
4.2 Plans and billing
Growtsy offers a free plan and paid subscription plans billed monthly or annually. Paid plans renew automatically at the end of each billing period using your stored payment method until cancelled. You will be charged the then-current price of your selected plan.
4.3 Allowances and credits
Each plan includes an allowance of Scout runs, Listing Analyses and Photo Studio photos, shown on the Pricing page. On paid plans the allowance renews every 30 days from the start of your usage period; unused allowance does not roll over. Photo credit packs and bonus credits are one-time additions: they are not reset when your allowance renews and they do not change your plan. Allowances and credits have no monetary value outside the Service and cannot be exchanged for cash or transferred.
4.4 Taxes (VAT / sales tax)
Applicable taxes (such as VAT or sales tax) are calculated and collected by Paddle at checkout based on your location and the applicable tax rules. Paddle's checkout shows the amount you will pay before you confirm.
4.5 Price changes
We may change the price of subscriptions. For active subscribers, price changes take effect at the start of the next billing period following at least 30 days' advance notice by email. If you do not accept a price change, you may cancel before it takes effect.
4.6 Failed payments
If a payment fails, Paddle will retry it and we will tell you by email and in the app. If the payment cannot be collected, your paid features may be suspended until the balance is resolved.
5. Free Plan
The free plan is a one-time (lifetime) allowance: 1 Scout run, 1 Listing Analysis and 3 Photo Studio photos, plus any welcome or bonus credits you earn. It does not renew or reset. Some features are only available on paid plans. We reserve the right to modify free plan allowances, features, or eligibility with 30 days' notice.
6. Cancellation and Refunds
You may cancel your subscription at any time from Settings → Usage & Plans in the app, or by emailing hello@growtsy.com. Cancellation takes effect at the end of your current billing period; you retain access to paid features until that date. Refund eligibility is described in our Refund Policy, which forms part of these Terms.
For EEA, UK, and Turkish consumers, statutory cancellation and withdrawal rights under applicable consumer law remain unaffected.
7. Your Content and License to Us
You retain full ownership of the content you upload to Growtsy (including product images, text, and descriptions) and of the outputs generated from your content (optimized titles, tags, descriptions, generated images), subject to Section 8 regarding the legal nature of AI-generated material.
To operate the Service, you grant Growtsy a limited, non-exclusive, worldwide, royalty-free license to:
- Transmit your uploaded content to our AI sub-processors (currently Anthropic and fal.ai) solely to generate the outputs you request.
- Store your content and outputs in Supabase Storage for as long as needed to deliver Library, history, and related features (see our Privacy Policy for retention periods).
- Display your content back to you within the Service.
We do not use your content for AI model training or for any purpose other than providing the Service to you. This license ends when you delete the content or your account.
Photos containing people. If you upload a photo that contains an identifiable person's face (your own face, a model, or a customer), an AI model checks the photo and returns a yes/no flag for whether a face is present, and generation then uses framing that leaves the face out. This check does not extract, store, or transmit facial geometry, faceprints, biometric templates, or other biometric identifiers as defined under laws such as the Illinois Biometric Information Privacy Act (BIPA, 740 ILCS 14). For details on how we handle photos containing people, see Sections 6 and 11 of our Privacy Policy.
8. AI-Generated Output
8.1 No guarantees of results
Growtsy uses artificial intelligence (Claude by Anthropic, FLUX Kontext Pro by fal.ai) to generate recommendations and visuals. AI outputs are provided as a starting point. They may contain errors, omissions, or content that does not comply with Etsy's current policies.
You are solely responsible for reviewing, editing, and approving all AI-generated content before publishing it to Etsy or using it commercially.
We make no representations or warranties that using Growtsy will result in:
- Increased sales, traffic, favorites, or conversions.
- Specific Etsy search rankings or positions.
- Approval or continued good standing of your Etsy shop.
- Compliance with every current or future Etsy policy.
8.2 Ownership and copyright of AI outputs
Subject to your payment of applicable fees and compliance with these Terms, you may use the outputs you generate using the Service (optimized titles, tags, descriptions, and AI-generated images) for your Etsy listings and related commercial purposes. We do not claim ownership of these outputs.
Our AI sub-processors operate under different terms:
- Anthropic (Claude): Under Anthropic's Commercial Terms, customers retain ownership of outputs they generate, and Anthropic assigns to us any right, title, and interest it may have in those outputs. We pass these rights through to you.
- fal.ai (FLUX Kontext Pro): fal.ai grants commercial use rights for FLUX Kontext Pro outputs but does not transfer ownership of outputs and does not warrant that outputs are unique, original, or non-infringing. Outputs may be similar to or identical with outputs generated for other users. Your right to use AI-generated images is therefore a commercial use license, not exclusive ownership.
The legal status of AI-generated content is evolving. The U.S. Copyright Office's January 2025 report (Copyright and Artificial Intelligence, Part 2: Copyrightability) concluded that:
- Material generated solely from text prompts, without sufficient human creative control, is generally not eligible for copyright protection.
- However, when a human contributes their own copyrightable input (for example, an original product photograph) and that human authorship remains perceptible in the output, the perceptible human contribution remains protected.
- Creative selection, arrangement, or modification of AI outputs by a human can also support copyright protection.
For most Photo Studio outputs, you upload your own product photograph (your own creative work) and the AI modifies the scene around your product. Your original photograph and the elements derived from it may be eligible for copyright protection under current U.S. guidance, while the purely AI-generated elements (synthetic backgrounds, lighting, composition) may not be. This area of law is unsettled and other jurisdictions may reach different conclusions. We do not provide legal advice; consult a qualified attorney if copyrightability of specific outputs matters to you.
To strengthen the protection and originality of AI-assisted content you publish, we recommend adding meaningful human modifications — your own editing, retouching, original copy, or arrangement choices — before commercial use.
8.3 No warranty of originality or non-infringement
AI models can, by their nature, produce outputs that resemble existing works, brand language, or designs. Growtsy does not warrant that outputs are unique, original, or non-infringing. We employ technical safeguards including pre-generation brand and character detection, plagiarism checks against competitor listings, and prompt-level constraints — but these safeguards are not foolproof and do not constitute a guarantee of clearance.
Before publishing AI-generated visuals you suspect may resemble existing designs, we recommend reverse-image search through tools like Google Images or TinEye.
8.4 Your inputs, Etsy compliance, and your responsibility
You represent and warrant that:
- You own or have all necessary rights, licenses, and permissions for any photos, images, text, or other content you upload to the Service.
- Your uploads do not infringe any third-party intellectual property rights, including copyrights, trademarks, design rights, personality or publicity rights, or licensed patterns.
- Your uploads do not depict identifiable persons without their consent (other than yourself or models who have authorized commercial use).
- Your use of generated outputs on Etsy or elsewhere will comply with Etsy's Seller Policy and Creativity Standards in effect at the time of listing.
Etsy distinguishes between two situations. Under Etsy's Creativity Standards (last updated June 2025), the policy treatment of AI depends on whether AI is used to create the product itself or only to photograph and describe a product you yourself made:
- If your product is handmade or designed by you and you use Growtsy only to enhance your photos (background swap, lifestyle scene, lighting), to write listing copy, or to research keywords, Etsy treats this as standard photo editing and copywriting. No special disclosure is required, and you may use the "Made by a seller" or "Designed by a seller" categories as appropriate to your actual production process.
- If you use AI to create the product itself (for example, AI-generated wall art sold as a digital download or printed by a print-on-demand partner), Etsy requires you to use the "Designed by a seller" category and to disclose AI involvement in your listing description. Selling AI-prompt bundles separately is not permitted under current Etsy policy.
Listing-safe vs. Promo only. Within Photo Studio, Growtsy further distinguishes between visuals suitable for the Etsy listing gallery ("Listing-safe") and visuals intended for advertising, social media, or shop banners only ("Promo only" — for example, color-variation comparisons or AI-imagined packaging that does not reflect your actual SKU). You are responsible for using each output in the manner intended. Misusing a Promo only visual as a primary Etsy listing photo may violate Etsy's accurate-representation policy and is your responsibility.
Etsy may update its policies at any time. You are responsible for reviewing the Etsy Seller Handbook and Creativity Standards before publishing each listing.
8.5 Indemnification specific to AI content
In addition to the general indemnification in Section 13, you specifically agree to indemnify and hold Growtsy harmless from any claims arising out of: (a) your upload of content you did not have the right to use; (b) your publication of AI outputs that infringe third-party rights; (c) Etsy enforcement actions, including listing removals, shop suspensions, or DMCA notices, taken against your shop in connection with content you generated using the Service.
8.6 AI transparency disclosure (EU AI Act)
For users in the European Union, the EU Artificial Intelligence Act (Regulation 2024/1689) imposes transparency obligations on certain AI systems beginning 2 August 2026. We disclose the following so you can make informed decisions about Growtsy outputs:
- You are interacting with AI. Listing analyses, keyword research, copywriting, and photo generation features are powered by generative AI systems (Anthropic Claude, fal.ai FLUX Kontext Pro). Outputs are produced by machine learning models, not by human writers or photographers.
- AI-generated images. Photo Studio and VisualKit produce synthetic images. When such images include synthetic depictions of human models (for example, in "Woman wearing" or "Man wearing" slot styles), the depicted persons are not real and the imagery may meet the EU AI Act definition of a "deep fake" (Article 3(60)). If you publish such images for any purpose other than your own product listing — for example, on social media or in advertising — you may need to disclose under Article 50(4) that the content has been artificially generated.
- Watermarking and detection. If a generated image carries machine-readable provenance information (such as C2PA metadata), you should not strip or obscure it.
- Editorial responsibility. AI-generated text intended to inform the public on matters of public interest must be disclosed as AI-generated under Article 50(4) unless a human takes editorial responsibility. Growtsy listing copy is not "matters of public interest" content; nevertheless, you remain editorially responsible for any text you publish.
These obligations apply primarily to deployers of AI systems (Article 50(4)) and to providers of generative AI (Article 50(2)). Growtsy is a deployer; our AI providers are the providers under the Act. If your use of Growtsy outputs in the EU triggers your own transparency obligations, those obligations are your responsibility.
9. Intellectual Property
The Growtsy brand, website, software, designs, workflows, prompt systems, and all associated intellectual property are owned by us or our licensors. Nothing in these Terms grants you any rights in our intellectual property beyond the limited right to use the Service as described here.
If you believe content on the Service infringes your intellectual property rights, email hello@growtsy.com with the subject "IP Notice" and include: identification of the work, description of the alleged infringement, your contact details, and a statement of good-faith belief.
10. Third-Party Services
The Service integrates with third-party providers (Paddle for payments, Anthropic and fal.ai for AI processing, Supabase for data storage, Vercel for hosting, Resend for email, and Etsy's public Open API for reading public listing and shop data). The full list is in Section 6 of our Privacy Policy. Your use of those services is subject to their respective terms and privacy policies. We are not responsible for outages, errors, or acts of third-party providers, though we work to maintain reliable integrations.
11. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. We disclaim all implied warranties including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
Nothing in these Terms excludes or limits any liability that cannot be excluded under applicable law, including statutory consumer rights in the EEA, UK, and Turkey.
12. Limitation of Liability
To the maximum extent permitted by law, Growtsy, its founders, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost sales, lost rankings, loss of data, or business interruption, arising out of or related to your use of the Service.
Our total cumulative liability arising out of or relating to the Service will not exceed the greater of: (a) the total amount you paid us in the 12 months preceding the event giving rise to the claim, or (b) EUR 100.
This limitation does not apply to liability that cannot be limited under applicable law (for example, gross negligence, willful misconduct, or statutory consumer protection rights).
13. Indemnification
You agree to indemnify and hold harmless Growtsy from any third-party claims, losses, or expenses (including reasonable legal fees) arising from: (a) your uploaded content, (b) your use of AI-generated outputs, (c) your violation of these Terms, or (d) your violation of Etsy's policies or applicable law.
14. Suspension and Termination
We may suspend or terminate your account if you violate these Terms, abuse the Service, or create legal or security risk. Where practicable we will notify you first. Upon termination, your access ends immediately; paid fees for the current period are non-refundable except as required by our Refund Policy or applicable law.
You may delete your account at any time from Settings → Account; deleting your account also cancels an active subscription. Data deletion follows our Privacy Policy.
15. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-laws principles. Disputes arising under these Terms will be submitted to the exclusive jurisdiction of the Istanbul Courts and Enforcement Offices (İstanbul Mahkemeleri ve İcra Daireleri), except that consumers may also bring proceedings in the courts of their country of residence where required by applicable law.
For EEA and UK consumers: nothing in this section limits your right to rely on mandatory consumer protection provisions of the law of your country of habitual residence.
16. Changes to These Terms
We may update these Terms from time to time. For material changes, we will provide at least 30 days' notice by email or in-app notification before they take effect. Continued use of the Service after changes become effective constitutes acceptance.
17. Miscellaneous
Entire agreement. These Terms, together with the Privacy Policy and Refund Policy, are the entire agreement between you and Growtsy regarding the Service.
Severability. If any provision is found unenforceable, the remaining provisions remain in full effect.
No waiver. Failure to enforce any provision is not a waiver of that provision.
Assignment. You may not assign these Terms without our consent. We may assign them to a successor in connection with a business reorganization or acquisition.
18. Contact
